workshop for comment of the draft amendments to the Law on Social Insurance

On June 6, 2013, in Ho Chi Minh City, the Ministry of Labour - Invalids and Social Affairs in collaboration with the World Bank (WB) organized a workshop for collecting the comments on a draft law amending to the Social Insurance Law. Deputy Minister of Labour - Invalids and Social Affairs - Pham Minh Huan attended and spoke at the workshop.








     In the opening speech, Deputy Minister Pham Minh Huan said that social insurance law passed by the Congress in 2006 to create a legal basis to improve the efficiency of enforcement regimes and policies on social insurance. After 6 years of implementation, the voluntary social insurance increased the number of participants, but the rate of coverage is low. Therefore, the need for reforms to support stronger for the poor, the farmers to participate in social insurance, contribute to raise the social insurance coverage and building of a flexible social insurance system .
 
     According to Ms. Tran Thi Thuy Nga - Director of the Department of Social Insurance (Ministry of Labour - Invalids and Social Affairs), after 6 years of implementation, besides the results, Social Insurance Law has revealed many shortcomings. Specifically, the Law has not managed the subjects of compulsory social insurance. The number of people participating in social insurance occupies only about 20% of the labour force; the participants in the voluntary social insurance occupy only 0.22% of the people involved. Situation of debt or delay paying social insurance money is quite common, especially in non-state enterprises and FDI enterprises (accounting for over 70% of total debt)...
 
    At the workshop, the participants heard and discussed issues such as trends in the world of the pension system and reform, management of social insurance in the world, the specific responsibilities of the bodies of state management on social insurance, raising the retirement age of labourers, capabilities of management to invest of retirement fund; the ways to expand the coverage of social security to the labourers; How to ensure equitable economic benefits for labourers in the different sectors…
 
    In addition, the participants of the workshop also suggest, it needs to promptly remedy the difficulties and obstacles in the implementation process of social insurance law, especially ensuring the interests of participants of social insurance; Should strengthen regulations of sanctions for violations of the social insurance law; Ensure deterrence, limit of violations, protect the legislation of social insurance; Ensure the implementation must be simple, easy, convenient, time and full rights for the social insurance participants.

     The Draft Law on Social Insurance (Amendment) consists of 10 chapters, 120 articles. It is expected that the Draft will be put to the National Assembly for collecting opinions at the 6th session in late 2013.
