The impact of new labour law to the enterprise governance

That is the theme at the employer conference was held on May 8, 2013 in Hanoi by the Vietnam Chamber of Commerce and Industry (VCCI) to collect opinions continuing for improving labour laws in this context.










     Attending the meeting were Mr. Bui Sy Loi Deputy Chairman of the Committee on Social Affairs of the National Assembly, Mr. Pham Minh Huan, Deputy Minister of Labour - Invalids and Social Affairs, Mr. Pham Gia Tuc, Vice President of the Vietnam Chamber Commerce and Industry with representatives from Vietnam Social Insurance Agency, the General Confederation of Labour, Vietnam, the Central Economic Committee and other organizations.
 
     The relevant content is presented at the conference include: VCCI research report on the impact of minimum wage policy increase on employment issues and the enterprise governance; Orientation of the Committee of the National Labour Relations in promotion the role of the Organization representing for employers in the construction of harmonious labour relations in Vietnam and expected model of National Wage Council; Review recommendations of representatives of foreign business associations to amend of labour policy; Assessment the impact of the Labour Code and Trade Union Law Amend on the operation of the Career Business Associations; The views of the Council of Labour Users/ enterprises…
 
     Speaking at the conference, Deputy Minister Pham Minh Huan stressed that, in 2013, the economic situation of Vietnam is continuing to face many difficulties, so the Government has shown a determination to stabilize the macro economy and withstand challenges and not set goals to run on high-growth, curb inflation, ensure social security gradually, toward restructuring the economy towards improving quality, efficiency and competitiveness...
 
     We all agreed that the new Labour Code was amended to resolve many unsolved and unclear problems of the Labour Code in 1994 and create positive change in the harmonious labour relations between the employer and the employee. However, the new Labour Code has a number of problems arise making difficulties for businesses. The conference is a forum and an opportunity for the organization to comment on the policy as well as the impact of policies to issues of corporate governance, competitiveness of enterprises and environment of business in Vietnam, contributing to further improvement of legislation on labour to fit the current economic conditions.
 
     Deputy Chairman of the Committee on Social Affairs of the National Assembly Bui Sy Loi said, in the context of the current economic situation, the adjustment of the minimum wage  will cause difficulties for enterprises because of hearing information to adjust minimum wage, employee will mental fluctuate and may have activities to arise strike. Enterprises incur additional costs related to many kinds of insurance such as health insurance, social insurance which base on the basic wage.
 
     The conference participants also raised questions about many ideas to increase the minimum wage, extra working hours, the role of trade unions as well as the impact, the influence of it on production and business of enterprises.
