Validation workshop of the regional study on changing nature of employment relationships as the impact of the use of ICT and adequacy of legislations in regulating employment relationships

On July 29 -30 th, 2019, in Hanoi, Ministry of Labour – Invalids and Social Affairs in cooperation with the ASEAN Secretary Board held the validation workshop of the regional study on changing nature of employment relationships as the impact of the use of ICT and adequacy of legislations in regulating employment relationships. The workshop aimed at creating an opportunity for representatives of labour channel from member states of ASEAN and relating international agencies, organizations to evaluating the researching results, the recommendation in the draft of report as well as discussing on the next step in the research.

Attending the workshop were Deputy Minister Doan Mau Diep, representatives from Senior of Labour Official Meeting (SLOM), ASEAN Secretariat; JustJobs network, ASEAN Trade Union Council (ATUC), ASEAN Employers Commission (AEC), ASEAN CRS network and the member states of ASEAN, relating agencies.

Addressing the workshop, Deputy Minister Doan Mau Diep said that in 21 Century, the world witness the breakthough of information technology, internet, automation, development based on knowledge and Artificial Intelligence (AI). Innovating technology has brought many progresses on productivity, effects of manufacture and business. While, technology has changed nature of employment, some jobs has disappeared, some jobs has appeared. Accordingly, the restructure of labour market has effected to labourers and changed the relationship between employees and employers as well as the role of the State in management these changes. The economy basing on the technology foundation makes the huge changes to employment relationship. The ASEAN’s member states cannot stay outside.
Technology-based employment has provided great opportunities for self-employed workers, part-time workers and freelancers. Workers have the right to be active and flexible in their work. However, the arrangement of work in this form greatly affects the assurance of social security and the ability to join organizations and collective bargaining of workers. These two contents are related to the employment relationship. "When workers are not guaranteed social security, they are often considered as informal workers. Therefore, the arrangement of such work is causing self-employed workers, temporarily and part time workers, freelancers are not protected by the law, they are not guaranteed social security as well as legitimate rights and interests related to employment. The issue raise the requirement of amending, supplementing of policies / regulations in order to solve them all "stressed Deputy Minister Doan Mau Diep.
In this context, Deputy Minister Doan Mau Diep said that under the framework of the ASEAN Labour Ministers Program in 2016-2020, the implementation of "Regional study on the changing nature of employment relations under the impact of the use of information technology and the adequacy of legislation in regulating employment relationships” chaired by Vietnam has a very urgent and important meaning. The research report aims to provide an overview of the technology situation that is changing the ASEAN labour market, in particular the technology is changing the form of employment and impacting on employment relations. Draft reports have also been developed by JustJobs Network’s experts and preliminary consultations with member countries.
The Deputy Minister believed that the opinion and comments of the participants in the Workshop will help the consultant of  JustJobs Network complete the content of the report soon. It is hoped that this report can become a useful reference for ASEAN member countries in grasping changes in the labour market, including changes in employment relationships caused by impact of technology as well as concern on adequacy amendments and supplements to labour policies to address the above situation.
