DECISION
On Roles, Responsibilities, Duties, Authorities and Organization
of Department of Personnel and Organization
 
 
THE MINISTER OF LABOUR - INVALIDS AND SOCIAL AFFAIRS
 
  Pursuant to the Law of the Government Organization dated 19th June 2015;

Pursuant to the Decree No. 123/2016/ND-CP of the Government, dated  01st September 2016, which stipulates roles, duties, authorities and organization structures of Ministries and Ministerial-level organizations;

Pursuant to Decree No. 14/2017/ND-CP of the Government, dated 17th February 2017, which  stipulates roles, duties, authorities and organization structures of the Ministry of Labour - Invalids and Social Affairs;

Upon the proposal of the Director General of the Department of Personnel & Organization

 

DECIDES

 

Article 1. The Department of Personnel & Organization is a unit of the Ministry of Labour - Invalids and Social Affairs, has the responsibilities and duties to assist the Minister to exercise a harmonized state management and implementation all activities in the filed of organization & personnel; in training, fostering to all Civil servants, officials and employees within the responsible areas of the Ministry in line with the laws.

Article 2. The Department of Personnel & Organization and has the following duties

1. Carrying out research works and submitting to the Ministry programs on personnel organization and activities of training and knowledge improvement for the civil servants, officials and employees under the management of the Ministry.

2. Providing guidelines to and monitoring the implementation of the State's and the Ministry's regulations on roles, responsibilities & duties, on activities of organization & personnel management and on training and fostering for civil servants and officials of the units under the Ministry.

3. On the area of organization and structure

a) Carrying research works and submitting to the Ministry:

- Functions, duties, authorities and organization structure of the Ministry; and organization structure of the units under the Ministry;

- Providing the functions, duties, authorities and organization structure of the professional agencies on labour, people with merits and social affairs under the People’s Committee at all level;

- Scheme, measures for foundation, changing model, dissolve, merger and re-structuring of dependent organizations of units under the Ministry;

b) Coordinating and cooperating with other related units to build the plan of network, the criteria for unit level classification of stated-owned functional units in the field of Labour – Invalids and Social Affairs;

c) Providing the guideline for stated-owned self-finance units on implementation of the duties, financial issues, organization structure, personnel in order to decide the number of employees working on the base of employment positions and civil servants structure in accordance with the professional titles approved by the authorities.

d) Submitting to the Ministry to establish or assigning to the Head of the units under the Ministry of Labour – Invalids and Social Affairs to establish the Management Board of the Scheme, plan in accordance with the law and regulation of the Ministry;

4. On the area of personnel

a) Carrying out research works and submitting to the Ministry

- Structure of the leaders, managerial staffs, plans of personnel movement of managerial staff, plan of personnel movement of professional & occupational staff;

- Recruitment plan of officials and implementation after the approval;

- Preparing working regulations and procedures of personnel activities; procedures for staff evaluation, recruitment, for salary level / ladder increase, for promotion, re-promotion, resignation; dismissal and other procedures relating to personnel area in line with legal requirements.

- Regulating the managerial titles’ standard for the units under the Ministry; guiding the standard of managerial titles of professional units in the field of labour – invalids and social affairs under the provincial, central affiliated cities’ People Committee in accordance with the law;

- Approving and providing guideline for the units under the Ministry implementing the recruitment, reception, movement, dispatching, salary level, allowance, grade, professional title and the other policies for officials, public servants, employees;

-Dispatching officials, public servants, employees to business trip, study and solve individual issues in accordance with the regulation of law and assignment of the Ministry.

b) Coordinating and cooperating with the relating unit to prepare and submit to the Ministry:

-  Structure of officials grade, public servant structure based on professional titles in the units under the Ministry;

-  Policies & schemes applied to officials, public servants, employees in the sector of labour – invalids and social affairs;

c) Providing guideline, implementation of the management of the officials’, public servants’ and employees’ profiles; the scheme of statistic, report, quality of all officials, public servants, employees under the Ministry.

Regulations on organization structure: Procedures for staff evaluation, recruitment, for salary level / ladder increase, for promotion, re-promotion, resignation; dismissal and other procedures relating to personnel area in line with legal requirements.

5. Training and fostering for officials, public servants:

a) Researching and submitting to the Ministry the plan, program, long-term and annual project on training, fostering for officials, public servants; carrying out and coordinating for implementation after the approval.

b) Managing the training activities of the institutions under the Ministry as prescribed by law and assigned by the Ministry.

c) Accrediting the training programs, documents, for training and fostering officials, public servants in the sector of labour – invalids and social affairs as the regulation;

6.  Managing managerial staffs, officials, public servants, employees, implementing internally politic protection within the regulation of law and the responsibility scope of the Ministry.

 7. Submitting to the Ministry to send members participating in to the inter-sectoral organization;  

8.  Implementing the duties of reforming the administrative organization, building and improving the quality of officials, public servants as the program, plan on administrative reforming of the Ministry.

 9. Carrying out research works;  Communication and disseminating the law for civil servants, employees and laborers; Carrying out and coordinating to implement the tasks of inspecting, settling complaints, denunciations, commendation and disciplining as assigned by the Ministry.

10. Providing management over personnel, physical assets, finance sources in lines with laws and as assigned by the Ministry.

 12. Performing other tasks as required by the Ministry.

 Article 3. Organization of the Department of Personnel & Organization

1. The Department has one Director General and not over 03 Deputy Directors General

 2. Functional divisions include:

             - Division of Organization and Structure;

           - Division of officials, public servants;

           - Division of Training.

Article 4. The Department Director General's duties include setting up and execution of the working & working relation regulations of the Department; specifying roles and duties of the functional sections; managing and specifying tasks and works within the staff to ensure the completion of the assigned duties and tasks.

Article 5. This decision comes into force from the date of signing and supersedes Decisions No.845/QD-LDTBXH dated June 05th, 2013 of the Minister of Labour – Invalids and Social Affairs on functional, duties, authorities and organization structure of the Department of Personnel & Organization.

Article 6. The Chief of the Ministry Office, the Director General of the Department of Personnel & Organization, Director General of the Department of Planning - Finance and the heads of the related units bear full responsibility for implementation of this Decision.
