Pursuant to the Law of the Government Organization dated 19th June 2015;
Pursuant to the Decree No. 123/2016/ND-CP of the Government, dated 01st September 2016, which stipulates roles, duties, authorities and organization structures of Ministries and Ministerial-level organizations;
Pursuant to Decree No. 14/2017/ND-CP of the Government, dated 17th February 2017, which stipulates roles, duties, authorities and organization structures of the Ministry of Labour - Invalids and Social Affairs;
Upon the proposal of the Director General of the Department of Personnel & Organization
Article 1. The Department of International Co-operation is a unit of the Ministry of Labour - Invalids and Social Affairs, has the responsibilities and duties to assist the Minister in execution a harmonized state management over the international co-operation & integration activities in the field of labour, the people with special contribution & social affairs as specified by laws.
The official name of the Department for international transaction is the Department of International Cooperation, in short form is ICD.
Article 2. The Department of International Co-operation has the following duties
1. Carrying out research works and submitting to the Ministry:
a) Programs, long-term & annual plans, projects and planning of international co-operation & integration in the area of labour, the people with special contribution & social affairs;
b) Orientations and measures for enhancement of co-operation with countries, territories, international organizations, regional and foreign organizations and individuals;
c) Participating in submitting proposals for negotiation and signing, getting approval for ratification or joining, withdraw of clinging of opinions or measures of assurance for execution of international agreements;
d) Participating in international organizations of the areas of labour, the people with special contribution & social affairs as assigned by the Government;
e) Authorizing the Department’s dependent units, and foreign organizations & offices which are licensed by the central government offices, to conduct international conferences, seminars and workshops related to the Ministry’s state management areas;
f) Carrying out research works on procedures, principles, processes and responsibilities of the Ministry’s units in implementation of international cooperation activities;
g) Preparing financial plans for international co-operation duties.
2. Responsible for implementation of :
a) Being the coordinator of the Ministry in international co-operation and integration area;
b) Organization of negotiation and signing of international agreement documents of international cooperation programs and projects in the area of labour, the people with special contribution and social affairs as assigned by the Ministry;
c) Monitoring, coordinating the implementation of approved international cooperation & integration programs, long-term plans and annual plans, projects in the field of labour, people with great contribution and social affairs;
d) Evaluating international cooperation documents prepared by Ministry’s units before submitting to the Minister for approval;
e) Regulations of international co-operation and protocol, migration/ immigration formalities for incoming/ outgoing delegations of the Ministry; providing guidelines to units of the Ministry on protocol, migration / immigration formalities for the latter 's incoming/ outgoing delegations as required by the laws;
f) Acting as official spokesperson of the Ministry on the area of labour, the people with special contribution & social affairs in international co-operation activities in exchange of documents, at different forum, meetings, and engagements as authorized by the Ministry;
g) Carrying out lobby activities for international donation & sponsorship in the area of labour, the people with special contribution and social affairs through activities of advisory, coordination, policy dialogue, sharing and publication of information with international partners and Vietnam representative organizations aboard;
h) Conducting international cooperation & integration activities as assigned by the Ministry, assisting the Ministry in the area of human rights; being the focal point to assist the Ministry in implementing state management activities to foreign organizations who work in the fields responsible by the Ministry;
i) Receiving and cooperating with other concerned units to evaluate dossiers suggesting for recognition & reward to foreign organizations and individuals granted by the Ministry and Vietnam; advisory on the receiving and cooperating with other concerned units to evaluate dossiers suggesting for recognition and reward granted by foreign counterparts to individuals and organizations under the Ministry.
3. Providing guidelines and monitoring the execution of State's and the Ministry’s regulations on international co-operation & integration of the Ministry 's units.
4. Monitoring, compiling and evaluating, making periodical and incidental reports on the Ministry’s activities of international co-operation and integration.
5. Carrying out external relation communication activities & research works; providing professional training on international co-operation & integration to the Ministry staff as assigned by the Ministry.
6. Managing staff, physical resources and finance as specified by the State and the Ministry.
7. Performing any other tasks requested by the Ministry.
Article 3. The Department 's Organization
1. The Department of International Co-operation has one Director General and not over 03 Deputy Directors.
2. The Department includes:
Section of General Affairs and Protocol;
Section of Multi Co-operation;
Section of Mutual Co-operation;
Section of ASEAN Cooperation.
Article 4. The Department Director General 's duties include setting up and responsible for the execution of the working relation regulations of the Department; specifying roles and duties of the functional sections; managing and specifying tasks and works within the staff to ensure proper completion of the assigned duties and tasks.
Article 5. This decision comes into force from the date of signing and supersedes Decision no. 489/QD-LDTBXH dated 19 March 2013 signed by the Minister of Labour - Invalids and Social Affairs which specifies roles, duties, authorities and organization structure of the Department of International Cooperation.
Article 6. The Chief of the Ministry Office, The Director General of the Department of Personnel & Organization, the Director General of the Department of Planning - Finance, the Director General of the Department of International Co-operation and the heads of the related units are responsible for implementation of this Decision.
